A bitter taste of reality for a Buckie ice cream maker
Imagine leaving the offshore world for a sweet life running an ice cream business, only to be met with a sour experience on day one. That's exactly what happened to Richard Simpson, who thought he was trading his old job for something sweeter. Little did he know, a simple phone call would turn his fresh start into a frozen nightmare.
On his first day as the proud owner of a local ice cream parlour and production unit, Richard received a call from an energy broker promising a great deal. Little did he know, this call would set off a chain of events that nearly threatened his entire business.
"That phone call ended up taking almost 20 minutes, and it was difficult to understand the person on the other end," Richard recalled. "They were using a lot of jargon, and I wasn't sure, but they insisted we were getting a fantastic deal at the best price possible."
When the paperwork arrived, Richard was shocked to find the deal was extraordinarily overpriced, with a 70% increase over the current price. The broker insisted he had already agreed to the contract, leaving Richard locked into a deal that threatened his business and caused immense stress and anguish.
But here's where it gets controversial... Richard discovered that small businesses lack the same protections as domestic customers. There's no 14-day cooling-off period, no signature required, and no safeguards. It's a loophole that allows brokers to take advantage of small businesses, and it left Richard feeling sick to his stomach.
Research by Consumer Scotland suggests Richard's experience is not an isolated incident. A recent survey found that one in five Scottish firms have faced similar problems with their energy contracts, impacting their turnover and profits. Most of these contracts are arranged through third-party brokers, who remain only lightly regulated.
David Eiser, head of investigations at Consumer Scotland, believes small business consumers need greater protections. "It's very clear that this market is complex, and we want to see broker services more robustly regulated," he said. Eiser has seen issues with transparency, disconnection, and the time taken to get reconnected, all of which impact small businesses.
Colin Borland, Scottish Director, calls for urgent action to rein in what he describes as "rogue brokers." He says, "They are overcharging people, mis-selling products, and operating in the Wild West. We need a new sheriff in town to enforce basic standards and protect small businesses."
The UK government has promised a clampdown on unregulated brokers, with plans to regulate every energy broker in the UK under Ofgem. Minister for Energy Consumers Martin McCluskey said, "Small Scottish businesses have been exploited for too long. We will end this exploitation and protect our local high streets and communities."
A consultation has recently closed, and legislation is expected soon. While the move is welcomed, there are calls for further reforms to treat small firms more like individual consumers.
Back in Buckie, Richard's ice cream business continues to thrive, but the experience left a lasting impression. "I felt this was wrong. You can't possibly allow people to be manipulated like that," he said.
This story highlights the need for greater protections for small businesses in the energy market. It's time to ensure that all businesses, big or small, are treated fairly and protected from exploitative practices.
